1. Agreement to Terms

By accessing or using the Vision Starter website located at https://visionstarter.ai (the "Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you must not access or use the Site. Vision Starter reserves the right to modify these Terms at any time, and your continued use of the Site constitutes acceptance of any changes.

2. Description of Services

Vision Starter ("we," "us," or "our") provides AI-powered technology solutions and automation services designed for home remodeling contractors, including but not limited to AI visualization video generation, AI-powered customer service chatbots, automated lead generation, smart scheduling and CRM tools, automated follow-up systems, and business analytics dashboards (collectively, the "Services"). The information provided on this Site is for general informational purposes and does not constitute a binding contract for services until a separate written agreement is executed between Vision Starter and the client.

3. Eligibility

You must be at least 18 years of age and legally capable of entering into binding contracts to use our Services. By using the Site, you represent and warrant that you meet these eligibility requirements. If you are using the Site on behalf of a contracting business or other legal entity, you represent that you have the authority to bind that entity to these Terms.

4. Use of the Site

You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to: (a) use the Site in any way that violates any applicable federal, state, local, or international law or regulation; (b) engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Site; (c) attempt to gain unauthorized access to any portion of the Site or any systems or networks connected to the Site; (d) use any robot, spider, or other automatic device to monitor or copy any content on the Site; or (e) introduce any viruses, trojan horses, worms, or other material that is malicious or technologically harmful.

5. Intellectual Property Rights

The Site and its entire contents, features, and functionality — including but not limited to all information, software, text, displays, images, video, audio, design, selection, and arrangement — are owned by Vision Starter, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site without the prior written consent of Vision Starter.

6. Service Plans and Pricing

All service plans, pricing information, and feature descriptions provided through the Site or during demonstrations are preliminary and subject to change based on the final scope of services, integration requirements, and other factors. A binding price will only be established through a separate written service agreement between Vision Starter and the client. Vision Starter is not responsible for any discrepancies between preliminary pricing and final service costs. AI-generated content, including visualization videos and marketing materials, are provided as tools to assist your business and do not guarantee specific business outcomes.

7. AI-Generated Content and Third-Party Integrations

Vision Starter utilizes artificial intelligence technologies to generate visualization videos, marketing content, chatbot responses, and other automated outputs. While we strive for accuracy and quality, AI-generated content may contain errors or inaccuracies and should be reviewed before use with your clients. Vision Starter is not responsible for business decisions made based on AI-generated content. Our Services may integrate with third-party platforms and tools; we are not responsible for the availability, accuracy, or performance of third-party services.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Vision Starter shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from: (a) your access to or use of or inability to access or use the Site; (b) any conduct or content of any third party on the Site; (c) any content obtained from the Site; or (d) unauthorized access, use, or alteration of your transmissions or content. In no event shall Vision Starter's total liability exceed the amount paid by you, if any, for accessing the Site during the twelve (12) months preceding the claim.

9. Indemnification

You agree to defend, indemnify, and hold harmless Vision Starter, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Site.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law provisions. Any legal suit, action, or proceeding arising out of or related to these Terms or the Site shall be instituted exclusively in the federal courts of the United States or the courts of the State of Wyoming, in each case located in Sheridan County. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

11. Termination

We may terminate or suspend your access to the Site immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Site will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
